1. Acceptance of Terms

By accessing or using Social Content Creator ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service. These Terms constitute a legally binding agreement between you ("User", "you", "your") and Social Content Creator ("we", "our", "us").

We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the updated Terms on this page with a new "Last updated" date. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.

2. Description of Service

Social Content Creator is a web-based application that enables content creators to:

  • Upload images for social media content creation.
  • Generate AI-powered, optimized text copy for multiple social media platforms including Instagram, Facebook, TikTok, X (Twitter), Telegram, and Threads.
  • Review, edit, and customize generated copy before publication.
  • Publish content directly to connected social media accounts via official platform APIs.
  • Track publication history and status across platforms.

3. Account Registration and Security

To use the Service, you must create an account through our authentication system. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

You are responsible for safeguarding your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account. We are not liable for any loss or damage arising from your failure to maintain the security of your account.

4. Social Media Account Integration

The Service allows you to connect your social media accounts for content publishing. By connecting your accounts, you:

  • Authorize us to access your social media accounts solely for the purpose of publishing content on your behalf.
  • Confirm that you are the authorized owner or administrator of the connected accounts.
  • Acknowledge that you are responsible for complying with each platform's terms of service and community guidelines.
  • Understand that we store your API tokens and credentials securely and use them exclusively for content publishing.
  • Can disconnect any social media account at any time through the Service settings.

We are not responsible for any actions taken by social media platforms regarding your account, including but not limited to account suspension, content removal, or policy enforcement.

5. Content and Intellectual Property

5.1 Your Content

You retain all ownership rights to the images and content you upload to the Service. By uploading content, you grant us a limited, non-exclusive, worldwide license to use, process, and transmit your content solely for the purpose of providing the Service (including AI analysis and social media publishing).

5.2 AI-Generated Content

The text copy generated by our AI tools is provided to you for your use. You are free to use, modify, and publish the generated content. However, you are solely responsible for reviewing and approving all AI-generated content before publication. We do not guarantee the accuracy, appropriateness, or compliance of AI-generated content with any platform's guidelines.

5.3 Our Intellectual Property

The Service, including its design, features, algorithms, and underlying technology, is owned by Social Content Creator and is protected by intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Service without our express written permission.

6. Acceptable Use Policy

You agree not to use the Service to:

  • Violate any applicable laws, regulations, or third-party rights.
  • Upload or distribute content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable.
  • Upload content that infringes on any intellectual property rights of others.
  • Distribute malware, viruses, or any other harmful software.
  • Attempt to gain unauthorized access to the Service or its related systems.
  • Use the Service for spam, unsolicited advertising, or bulk messaging.
  • Interfere with or disrupt the integrity or performance of the Service.
  • Impersonate any person or entity, or falsely state or misrepresent your affiliation with a person or entity.

We reserve the right to suspend or terminate your account if we determine, in our sole discretion, that you have violated these Terms.

7. Content Responsibility

You are solely responsible for all content you upload, generate, and publish through the Service. This includes ensuring that:

  • You have the right to use and publish all uploaded images.
  • Your content complies with the terms of service and community guidelines of each social media platform.
  • You review all AI-generated copy before publishing to ensure accuracy and appropriateness.
  • Your content does not violate any applicable laws or regulations.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The Service will be uninterrupted, timely, secure, or error-free.
  • The AI-generated content will be accurate, complete, or suitable for your purposes.
  • Social media publishing will always succeed, as it depends on third-party platform availability and policies.
  • The results obtained from the use of the Service will meet your expectations.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL SOCIAL CONTENT CREATOR, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your access to or use of (or inability to access or use) the Service.
  • Any conduct or content of any third party on the Service.
  • Any content obtained from the Service, including AI-generated content.
  • Unauthorized access, use, or alteration of your transmissions or content.
  • Actions taken by social media platforms regarding your account or content.

10. Indemnification

You agree to indemnify, defend, and hold harmless Social Content Creator and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorney's fees, arising out of or in any way connected with your access to or use of the Service, your content, or your violation of these Terms.

11. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease. You may also terminate your account at any time by contacting us.

Upon termination, we will delete your personal data in accordance with our Privacy Policy, except where we are required to retain it by law.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the European Union and the applicable national laws, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved through the competent courts of the applicable jurisdiction.

13. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable.
